TERMS OF USE
1. Acceptance of Terms
Accessing and using the MyUrbs platform (myurbs.org) implies full acceptance of these Terms of Use. Anyone who does not accept these terms is asked not to use the platform. Registering for the service constitutes explicit acceptance of these Terms and the related Privacy Policy.
2. Description of the service
MyUrbs is a free participatory artistic platform that allows registered users to:
• Publish independent events with title, description, date, location and category (tag)
• View events of interest on the map based on their location and selected tags
• Receive notifications about events matching their preferences
• Participate in published events in person or through simultaneous action
• Share images and contact information through their public profile
The service is provided without guarantee of continuity or permanent availability, as it is an artistic project with limited resources.
3. Registration requirements
To register, users must be at least 16 years of age and provide a valid email address. The user is responsible for the accuracy of the information provided at registration. Each user may create only one personal account. Sharing login credentials with third parties is not permitted.
4. User Generated Content
4.1 User responsibility
The user is solely responsible for the content they publish on the platform (events, descriptions, images, profile information). By uploading content, the user declares that they hold the relevant rights or have obtained all necessary authorisations for publication.
4.2 Licence granted to the Controller
By publishing content on MyUrbs, the user grants the Controller a non-exclusive, royalty-free, worldwide licence for the duration of the content's presence on the platform, for the purpose of displaying, distributing and making such content accessible through the service. This licence does not imply any transfer of the user's intellectual property rights and expires upon deletion of the content or account.
4.3 Artistic and research use of aggregated data
Consistent with the nature of the project, aggregated and anonymised data relating to published content (event types, geographic distribution, convergences of interests) may be used by the Controller for artistic and research purposes, including installations, visualisations and publications related to the Die Komödie! project and any subsequent developments. Such processing does not allow identification of individual users.
4.4 Prohibited content
It is strictly prohibited to publish content that:
• Is unlawful, defamatory, obscene, violent, discriminatory, or harmful to the dignity of individuals
• Infringes third-party intellectual property rights (copyright, trademarks, patents)
• Contains personal data of third parties without their explicit consent
• Constitutes spam, unauthorised promotional messages or content of a commercial nature
• Spreads false or misleading information
• Contains malware, malicious code or links to harmful resources
The Controller reserves the right to remove without notice any content that violates these provisions and to suspend or delete the account of the responsible user.
5. User conduct
The user agrees to use the platform responsibly, with respect for other users and the participatory spirit of the project. Behaviours that obstruct the functioning of the platform, attempt unauthorised access to systems or other users' data, or conflict with the artistic and social purposes of the project are prohibited.
6. Intellectual property of the platform
The MyUrbs platform, its source code (distributed as open-source), name, logo and editorial content produced by the Controller are protected under applicable intellectual property laws. The user does not acquire any rights over the platform itself merely by using it or registering.
7. Account deletion
The user may request deletion of their account at any time by contacting the Controller via the form in the Contact section. Deletion results in the removal of all personal account data, except data that the Controller is required to retain by law. Content published by the user (events) may be removed from the map at the time of account deletion, upon the user's explicit request.
8. Limitation of liability
The Controller does not guarantee the continuity, error-free operation or permanent availability of the service, as it is an artistic project with limited resources. The Controller is not responsible for content published by users, for any damages arising from the use or inability to use the platform, or for actions taken by users following participation in published events.
9. Governing law and jurisdiction
These Terms of Use are governed by Italian law and European Union law. For any dispute relating to the interpretation or application of these Terms, the parties will attempt an amicable resolution. In the absence of agreement, the court of the Controller's place of residence shall have jurisdiction, without prejudice to the right of consumer users to bring proceedings before the court of their own domicile.
10. Changes to the Terms
The Controller reserves the right to modify these Terms of Use. Material changes will be communicated to registered users via email or an in-platform notice with at least 15 days' advance notice. Continued use of the platform after changes take effect will constitute acceptance of the updated Terms.
